What Are the Damages You Can Recover in a Personal Injury Case?

If you suffered injuries because of the negligence of another party, you may be entitled to recover compensation for the losses those injuries have caused you to suffer. In Ohio, Kentucky, and Indiana, the damages in a personal injury case are generally separated into three categories.

Economic Damages

Economic damages, also known as special damages, are those that are linked to a set monetary value. They include things like medical bills, lost wages, and other financial losses. Punitive Damages

Punitive damages are only available in limited situations. To trigger punitive damages under Kentucky law, for instance, the action or inaction must demonstrate oppression, fraud, or malice. In Ohio, the action or inaction of the defendant must demonstrate malice or aggravated or egregious fraud for the plaintiff to be awarded punitive or exemplary damages. Under Indiana law, clear and convincing evidence must demonstrate that the defendant acted with malice, gross negligence, oppressiveness, or fraud.
